FUBARA: Any impeachment done in hotel alien to law according to Supreme Court – Falana
Mr. Femi Falana, a senior advocate of Nigeria, has revealed the Supreme Court’s stance on where House of Assembly members can legally hold sittings.
This was coming as Governor Siminalayi Fubara of Rivers State ordered the Rivers State House of Assembly to temporary relocate its sittings to the Government House due to the unavailability of their official chamber, which was damaged by fire and subsequently demolished for reconstruction.
In a video recently shared on YouTube by Channels TV, Fubara referenced a past case in Oyo State where the House of Assembly purportedly sat in a hotel to impeach then-Governor Rashidi Ladoja.
He said the Supreme Court ruled that such actions are not in line with the constitution. He said the court made it clear that any sitting of the House of Assembly outside of its designated complex would not be recognized by law.
Falana explained that this means that meetings held in locations other than the official assembly premises would not carry legal weight or validity.
In Falana’s words: “Supreme Court made it clear that an impeachment carried out in hotel is alien to section 188 of the constitution”.
