Abuja court adjourns Nafiu Bala Gombe’s case against David Mark, cites ‘judicial rascality’

Nafiu Bala, without going any election or party resolution, has declared himself National Chairman and is seeking an order restraining the Independent National Electoral Commission (INEC) from recognising the David Mark-led executive, while compelling INEC to recognise his leadership of the party.

A Federal High Court in Abuja has reportedly adjourned indefinitely a suit filed by Nafiu Bala challenging Senator David Mark’s leadership of the African Democratic Congress (ADC).

Presiding Justice Emeka Nwite ruled on Tuesday that it would amount to “judicial rascality” for the court to hear the matter while an interlocutory appeal is still pending before the Supreme Court.

The judge noted that the appeal before the apex court is capable of disposing of the entire issue at the trial court.

Bala, a former National Vice Chairman of the ADC, had in the suit filed on September 2, 2025, claimed he never resigned his position and argued that he ought to have assumed leadership of the party in line with its constitution following the exit of Ralph Nwosu as National Chairman.

Justice Nwite consequently adjourned the suit sine die (indefinitely) pending the hearing and determination of the appeal at the Supreme Court.
