Bayelsa Re-run: Option before APC’s David Lyon to participate – Bosun Oladele

The sacked Bayelsa State Governor-elect, Chief David Lyon, still has a lifeline to do the contest again but on one condition, that he goes back to court to determine whether or not he will be eligible to participate in the state’s governorship re-run election expected to happen within the next 90 days in the state.
This postulation was given by former Member, House of Representatives representing Irepo/Orelope/Olorunsogo Federal Constituency, Oyo State in the Eighth National Assembly, Hon. Bosun Oladele, during an interview with The DEFENDER at his Oladele & Oladele Solicitors office in Lagos, on Monday.
The nullification of Governor Duoye Diri’s election by the state governorship election tribunal in Abuja, on Monday, has necessitated the re-run.
Chief Lyon and the All Progressives Congress (APC) had made effort to get the Supreme Court overturn its ruling of 13 February, which sacked the governor-elect on the ground of disqualification of his deputy, but the apex court dismissed the applications for review of the judgment, saying no force can make it reverse itself on the judgement that legal opinion has described as travesty of Justice.
But Bosun Oladele, who was Oyo State Commissioner for Information and Orientation during the first four-year term of Ishaq Abiola Ajimobi administration, said by the judgement that pulled the rug off his feet, Lyon will not be eligible to participate in the re-run unless he does one thing, which is to go back to court and seek an injunction for inclusion.
How to achieve this the APC chieftain and seasoned lawyer said, “If I were David Lyon or I want to advise, I would ask him to go back to court, primarily, to seek the interpretation of that judgement vis-a-vis his own qualification or otherwise.
“I am saying this because, to me, it was the deputy governor-elect that was disqualified not the governor-elect. The governor is qualified by virtue of his own qualification and what have you.
“And that, going back to court, will determine if he can context for this re-run election or not,” Oladele said.
